ORDER 1. The present petition has been filed by Smt. Fooli Devi for issuance of an appropriate writ, order or direction directing the respondents to disburse the entire amount awarded by the Commissioner of Workmen’s Compensation on account of death of her son. 2. The fact of the case reveals that by virtue of an award dated 31.01.2012 passed in Case No.2/2010 WCF a total sum of Rs.3,76,114/- has been awarded to the claimants. However, out of the aforesaid amount, only a sum of Rs.70,000/- has been disbursed to the petitioner and the entire amount has been kept in a fixed deposit. 3. Petitioner’s contention is that her husband also expired during the pendency of the litigation and now she is all alone and she is in need of money to pay the dues which have incurred towards the treatment of her late husband. 4. Learned counsel for the petitioner has fairly stated before this Court that 50% of the awarded amount be kindly disburse in favour of the widow and the remaining amount be kept in the fixed deposit as directed by the Commissioner. 5. The prayer appears to be a reasonable prayer. 6. Respondents as well as the Commissioner is directed to release the 50% of the total awarded amount to the petitioner within thirty days from today and to keep the remaining amount in the fixed deposit as held in the award dated 31.1.2012. 7. The writ petition stands allowed. 8. No order as to costs.
