JUDGMENT 1. - This writ petition has been filed by the petitioner working as Lab Technician challenging his transfer order dated 27.6.2008 (Annex.8), whereby the petitioner has been transferred from Keru To Udaipur. 2. Under the interim order of this Court, the operation of the impugned order was stayed and considerable time of about 5 years have elapsed since then and therefore, at the joint request of learned counsels for the parties, this writ petition is disposed of with a direction that the impugned transfer order will not now be enforced against the petitioner. However, the respondent - Department will be at liberty to pass fresh transfer order in accordance with law in the interest of administration. 3. With the aforesaid observations, the present writ petitions is disposed of. No costs. A copy of this order be sent to the concerned parties forthwith.Petition Disposed of. *******
