JUDGMENT Mr. Harinder Singh Sidhu, J. (Oral):- Bal Kishan @ Langri has filed this writ petition for grant of parole under Section 3(1)(b) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 (for short the Act) in order to attend the marriage of his real sister’s son on 21.04.2014. 2. Vide order dated 19.12.2012 passed by learned Additional Sessions Judge, Rohtak, the petitioner was sentenced to undergo rigorous imprisonment for a period of 10 years for an offence punishable under section 18 of the Narcotic Drugs & Psychotropic Substances Act, 1985 in case FIR No. 113 dated 23.04.2009, Police Station Kalanaur. He is presently undergoing sentence in District Jail, Rohtak. CRA-S No. 186-SB of 2012 filed by the petitioner before this Court was admitted vide order dated 23.01.2013 and is pending. 3. Counsel for the petitioner submits that the marriage of his real sister’s son is fixed for 21.4.2014. He has placed on record marriage card as Annexure P-1. He has also annexed copy of certificate of Gram Panchayat,, Katesara, District Rohtak verifying the factum of marriage. He also submits that the presence of the petitioner at the marriage of his real sister’s son is essential to perform certain ceremonies. 4. Notice of this petition was issued to the State of Haryana. Affidavit of the Superintendent, District Jail, Rohtak has been filed, wherein it has been stated that Section 2(aa)(1) of the Act defines the term ‘Hardcore Criminal’. As per provision of Section 2(aa)(i)(13) of the said Act a prisoner having committed “offence under Section 17(c) or 18(b) of the NDPS Act, 1985 (Central Act 32 of 2012)” is a Hardcore Prisoner and a Hardcore Prisoner can not be extended the benefit of Parole/Furlough under the rules. 5. Notwithstanding the above, in view of the fact the petitioner has to perform some ceremonial formalities in the marriage of his sister’s son, this petition is allowed. Accordingly, the petitioner is allowed to attend the said marriage, which is to be solemnized on 21.04.2014 at Rajput Dharamshala, Rohtak Gate, Bhiwani (Annexure P-1) under police escort for one day. The expenses for the said purpose would be borne by the petitioner. 6. Copy of this order be supplied to the counsel for the petitioner as also the State counsel for onward transmission to the concerned Authorities under the signatures of Special Secretary of this Bench. ---------0.B.S.0------------
