JUDGMENT Mr. T.P.S. Mann, J. (Oral):- Prayer made in the petition is for the grant of regular bail to the petitioner in a case arising out of FIR No.347 dated 7.4.2013 under Sections 18 and 29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station City, Panipat, District Panipat. 2. The aforementioned FIR was registered against Rakesh Kumar as he was found in possession of 2 kgs and 810 grams of opium. During his interrogation, he made statement that he had come to supply opium to the petitioner and one Baljit. Subsequent to the said statement, the police set up a naka and arrested the petitioner and Baljit. At that point of time, no contraband was recovered from the petitioner. The petitioner has, accordingly, been arraigned as accused under Section 29 of the of the Narcotic Drugs and Psychotropic Substances Act. 3. After obtaining instructions from ASI Ram Mehar, learned State counsel has informed the Court that apart from the present case, the petitioner is no involved in any other criminal case. The petitioner is in custody since 7.4.2013. Till date, only three witnesses have been examined by the prosecution and ten more are yet to be examined. The trial is now slated 26.4.2013 for recording of further evidence of the prosecution. 4. Without commenting on the merits lest it may prejudice the case of either party, this Court is of the considered view that further confinement of the petitioner will not serve any useful purpose. 5. Resultantly, the petition is accepted. Bail to the satisfaction of Chief Judicial Magistrate, Panipat. ---------0.B.S.0------------
