JUDGMENT Mr. Tejinder Singh Dhindsa, J. (Oral):- This order shall dispose of the present petition preferred under Section 438 Cr.P.C. seeking benefit of anticipatory bail to the petitioners in FIR No. 126 dated 07.11.2013 under Sections 420, 120-B IPC, registered at Police Station Chohla Sahib, District Tarn Taran. 2. While issuing notice of motion, this Court on 04.03.2014 has passed the following order :- “Learned counsel for the petitioners contends that civil suit in respect of sale deed in question has been lost by the complainant upto this Court. Notice of motion for 21.04.2014. In the meantime, in the event of arrest of the petitioners, they shall be released on interim bail on their furnishing bail/surety bonds to the satisfaction of the arresting officer and subject to compliance of provisions of Section 438(2) of the Criminal Procedure Code, 1973.” 3. Learned State counsel upon instructions from ASI Charan Singh would apprise the Court that the petitioners have since joined the investigation. It has also gone undisputed that the civil suit with regard the same very property in question was filed by the complainant and in such proceedings, the complainant has lost up to this Court. 4. In the totality of the circumstances, the petitioners are entitled to the concession of pre-arrest bail. Accordingly, the petition is allowed and the order dated 04.03.2014 passed by this Court is made absolute. Petition disposed of. ---------0.B.S.0------------
