JUDGMENT 1. This Transfer Civil Miscellaneous Petition has been filed praying to pass an order for withdrawal of IDOP.No.103 of 2012 pending on the file of the learned District and Sessions Judge, Kanyakumari District at Nagercoil, and to transfer the same to any other Family Court, Chennai. 2. The matter was referred for mediation to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, by the order of this Court, dated 06.02.2014. 3. A communication, dated 12.03.2014, of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, has been received, enclosing a copy of the Mediation Report, dated 11.03.2014, stating that the matter has been settled between the parties concerned, as per the terms cited in the Mediation Agreement, dated 11.03.2014. 4. As the parties have arrived at a settlement, in terms of the Mediation Agreement, dated 11.03.2014, this Transfer C.M.P. is listed for passing orders. 5. The Mediation Agreement, dated 11.03.2014, signed by the parties, as well as their respective counsels, reads as follows:- "Both sides, out of their own volition and without any pressure or coercion from any side have agreed as follows: 1. Petitioner / Wife and Respondent / Husband agree to settle the dispute amicably between them before the Mediation Centre. 2. Respondent / Husband returned a sum of Rs.4,00,000/-(Rupees four lakhs only) by cash and other gold jewels to the Petitioner / Wife. Petitioner / Wife received and acknowledged receipt of the same. 3. Petitioner / Wife returned the gold jewels to the Respondent / Husband. Respondent / Husband received and acknowledged receipt of the same. 4. Petitioner / Wife and Respondent / Husband agree for the transfer of I.D.O.P.No.103/2012 on the file of District and Sessions Judges, Kanniyakumari at Nagercoil to any Family Court, Chennai. 5. Petitioner / Wife and Respondent / Husband have agreed to file the Divorce by mutual consent jointly before the Family Court at Chennai. " 6. In terms of the settlement arrived at between the parties, which is recorded under the Mediation Agreement, dated 11.03.2014, this Transfer C.M.P. is disposed of. The terms of the Mediation Agreement, dated 11.03.2014, shall form part of the record. No costs. Connected Petition is closed.
