JUDGMENT Hon'ble Dilip Gupta,J. 1. The petitioner has furnished a representation on 25 September 2013 before the District Magistrate, Varanasi alleging that a religious structure has been constructed unauthorisedly on a government land next to the Police Station Gilat Bazar, District Varanasi. The petitioner has relied upon the directions issued by the Supreme Court on 29 September 2009 in a petition for Special Leave to Appeal (Civil) No.8915 of 2006 (Union of India Vs. State of Gujarat & Ors). For convenience of reference and for the guidance of the second respondent, we extract the direction of the Supreme Court which reads as follows: - "As an interim measure, we direct that henceforth no unauthorised construction shall be carried out or permitted in the name of Temple, Church, Mosque or Gurudwara etc. on public streets, public parks or other public places etc." 2. Since a representation has been made to the second respondent and which does not appear to have been disposed of, we dispose of the petition by directing the second respondent to take an appropriate decision, particularly having regard to the binding direction which has been issued by the Supreme Court as noted above. The writ petition is, accordingly, disposed of.
