JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of emergency parole to the petitioner for taking his BA- 2nd year Examination, which is to commence from 25.04.2014 and the last date of examination is 30.04.2014. Petitioner has also to take examination on 12.05.2014 for History paper of BA- 1st year. 2. In compliance of the notice issued on 23.04.2014, learned counsel for the State has put in appearance and has produced the affidavit of the Superintendent, District Jail, Sirsa, showing the period of incarceration suffered by the petitioner, which is taken on record. 3. Learned counsel for the State, on instructions from HC Mandeep Kumar, has not controverted the fact that the petitioner has to take his examination of BA-2nd year from 25.04.2014 to 30.04.2014 (both days inclusive) and on 12.05.2014 for BA-1st year. However, he submits that in view of the on-going Lok Sabha elections, convicts are not being released on parole. He further submits that there is no provision for releasing the convict on parole for taking the examination. 4. Learned counsel for the petitioner submits that for taking his examination of BA-1st year, the petitioner was ordered to be released on parole from 26.10.2012 to 17.11.2012 and after taking his examination, the petitioner surrendered before the competent authorities within time. He further contends that petitioner has already suffered incarceration for four years eleven months and eleven days and during his incarceration, he has not committed any offence or violated any provision of law. It has also been contended that petitioner was released on parole for four times but every time he surrendered in time. 5. I have heard learned counsel for the parties and with their able assistance gone through the material available on record. 6. In view of the totality of the facts and circumstances of the case and keeping in view the future of the convict Pardeep Kumar, he is ordered to be released on parole from 24.04.2014 to 01.05.2014 (both days inclusive) and he would surrender on 02.05.2014 at 10.00 a.m. before the Superintendent, District Jail, Sirsa.

In view of the totality of the facts and circumstances of the case and keeping in view the future of the convict Pardeep Kumar, he is ordered to be released on parole from 24.04.2014 to 01.05.2014 (both days inclusive) and he would surrender on 02.05.2014 at 10.00 a.m. before the Superintendent, District Jail, Sirsa. The petitioner shall also be released on parole for 11.05.2014 and 12.05.2014 and he would again surrender before the Superintendent, District Jail, Sirsa, on 13.05.2014 at 10.00 a.m., subject to his furnishing bond in the sum of Rs.1,00,000/- with two sureties in the like amount to the satisfaction of the Superintendent, District Jail, Sirsa. 7. The copies of the order be supplied to the learned counsel for the petitioner and the learned counsel for the State under signatures of the Special Secretary of this Court, for immediate compliance. ---------0.B.S.0------------
