Judgment 1. Heard both sides. 2. The petitioner retired from service on 31.03.2012. Though nearly about two years lapsed, pension proposals are not sent by the concerned authorities to the sixth respondent. In these circumstances, this Court passed the following order on 10.02.2014: "The petitioner retired from service on 31.03.2012. Nearly for the past two years, pension proposals are not sent. In fact, the period of absence during service was regularised by the Revenue Divisional Officer, Mettur, vide proceedings in ROC No.1040/2012/B, dated 22.08.2013. Even thereafter, pension proposals are not sent. 2. If the pension proposals are not sent, taking into account the aforesaid order dated 22.08.2013 of the Revenue Divisional Officer, Mettur, within a period of three weeks from today, this Court may take serious view and would direct the third respondent District Collector, Salem, to take action against the erring officials. 3. Post on 03.03.2014." 3. The learned counsel for the sixth respondent has submitted that the pension proposals were received and pension was authorized by the sixth respondent by the order dated 13.03.2014. 4. The learned counsel for the petitioner has submitted that the petitioner has not received leave salary and he is also not paid with any interest for the belated payment of pension and DCRG. 5. On the other hand, the learned counsel for the sixth respondent has also submitted that after authorizing pension, the service register and other papers were sent back to the fifth respondent and therefore, there is no impediment for the concerned authority to sanction leave salary. 6. Heard the learned Government Advocate on the above submissions. 7. Since there is a delay of two years, I am of the view that the petitioner is entitled to interest on the belated payment of pension and DCRG. Further, the petitioner is also not paid the leave encashment benefit, which he is entitled to. 8. In these circumstances, the fourth respondent, who is the immediate higher authority to the fifth respondent, is directed to see that appropriate order is passed granting leave benefit, along with interest, at the rate of 10%, in the light of the Division Bench judgment of this Court in GOVERNMENT OF TAMIL NADU, REPRESENTED BY THE SECRETARY TO GOVERNMENT VS. M.DEIVASIGAMANI [ 2009 (3) MLJ 1 ].
M.DEIVASIGAMANI [ 2009 (3) MLJ 1 ]. The said Division Bench judgment granted interest for the belated payment at the rate of 10%, following the decision of the Honourable Apex Court in S.K.DUA VS. STATE OF HARYANA [ 2008 (3) SCC 44 ]. Since there is a delay in payment of pension and DCRG, the first respondent is directed to pass appropriate orders and the interest shall be paid at the rate of 10 % per annum for those amounts also. The aforesaid exercise shall be completed by the first respondent within a period of twelve weeks from the date of receipt of a copy of this order. 9. This writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petition is closed.
