JUDGMENT Mr. Jaswant Singh, J.(Oral):- Defendants 1 to 3 are in revision under Article 227 of the Constitution assailing the order dated 27.11.2013 (P-6) passed by the learned Additional Civil Judge (Senior Division)Faridkot whereby their application under Order 26 Rule 9 CPC for appointment of a Local Commissioner has been dismissed. 2. Contesting respondents/plaintiffs have filed a suit for Permanent Injunction seeking to restrain the defendants/petitioners from interfering into the peaceful possession over the land measuring 5K2M bearing khasra no.2515//700. The case of the defendants, on the other hand, is that plaintiff no.2 had executed a registered sale deed dated 30.10.1989 qua land measuring 1 kanal in favour of defendants. In the said sale deed the khasra numbers have been wrongly mentioned as 699 min instead of khasra no.700 but the boundaries have been correctly indicated. Thus, both the parties are claiming possession over the suit property. 3. Learned counsel for the petitioners has submitted that appointment of a Local Commissioner is not for determining the possession but for demarcating the land as per the boundaries given in the sale deed. 4. Having heard learned counsel for the petitioners, this Court does not find any ground for interfering with the impugned order as it is apparent that the prayer in sum and substance tantamounts to collecting evidence on behalf of the parties which is impermissible in law. It will be open for the petitioners/defendants to lead their independent evidence in support of the pleas raised in the written statement. 5. Dismissed. ---------0.B.S.0------------
