JUDGMENT Tarlok Singh Chauhan, Judge ( Oral ) In terms of the advertisement (Annexure P-3), the essential educational qualifications have been prescribed as under: Name of Post Department No.of Educational Qualification Pay Post TUTOR – Anatomy 4 A) A Recognized Medical PB-3 with Medical Physiology 4 Qualification included in the Grade Pay of Rs.5400/- Teaching Biochemistry 4 first or second schedule to the plus non-practising Faculty Pharmacology 1 Indian Medical Council Act, allowance. Medicine Total 17 B) Should be registered with the Medical Council of India or State Medical Council. For Non Medical Council. A post graduate qualification i.e. Masters Degree in the concerned subject allied disciple i.e. – Medical Biochemistry, Medical pharmacology (note- The Respective subject, Allied disciple should be as in the Table-I of schedule I of the MCI “Minimum Qualification for the teachers in Medical Institutions Regulations 1998”. 2. Admittedly, the petitioner does not fall within any of the qualification so prescribed and is a Post Graduate in Pharmacy. The subject of Pharmacy, by no stretch of imagination, can be equated or termed to be equivalent to either degree in Medical Biochemistry or Medical Pharmacology. 3. Therefore, in this view of the matter, the petitioner has no locus standi to file the present petition much less challenge the action of the respondents. Accordingly, the same is dismissed in limine without any order as to costs. The pending applications are also disposed of.
