JUDGMENT Mr. M.M.S. Bedi, J. (Oral):- For having been found in possession of 19.500 kg. of poppy husk, the petitioner has been in custody w.e.f. October 10, 2013. 2. The quantity of poppy husk being non-commercial, the petitioner can be granted the concession of bail. 3. The petition has been opposed, inter-alia, on the ground that the petitioner is involved in another case of recovery of opium of non commercial quantity registered against him at Patiala in which the petitioner is on bail. 4. Taking into consideration the totality of the circumstances, I deem it appropriate to release the petitioner on bail on a condition that he will not commit the similar offence of which he is accused of during the entire period of trial. 5. Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court. The petitioner, at the time of his release would be required to furnish an undertaking that he will not indulge in similar activity of which he is accused of during the pendency of the trial. In case of involvement of the petitioner in any other case under NDPS Act, this order will be revoked on an application of the prosecution agency. ---------0.B.S.0------------
