Judgment : 1. This is the petition filed by the petitioner/accused No.1 under Section 439 of Cr.P.C. seeking his release on bail for the offences punishable under Sections 8, 12, and 21(2) of Protection of Children from Sexual Offences Act, 2012, registered in respondent - police station Crime No.404/2014. 2. Heard the arguments of the learned counsel appearing for the petitioner/accused No.1 and also the learned Government Pleader appearing for the respondent-State. 3. I have perused the averments made in the bail petition, FIR, complaint, and other materials placed on record. Mother of the victim girl Shantha, lodged the complaint stating that she is having two daughters by name Jayashree and Keerthana, who are studying in 5th and 3rd Standard respectively at Sri Maruthi Primary School and in that School four teachers are working, out of those teachers, petitioner is also one of the teacher, who from the last one month was giving sexual harassment to the second daughter of the complainant i.e., Keerthana. The Principal of the said school has been informed to take necessary steps against the petitioner but he had not taken any action. Therefore, the complainant approached the police and requested to take action against the petitioner. 4. I have perused the statement of victim girl Keerthana recorded by the Investigating Officer during investigation, so also the statement of teachers, who are working in the said school. The learned HCGP has submitted that the matter is still under investigation, Investigating Officer has to record some more statements and he has to file the final report in the matter. Therefore, at this stage, without expressing any opinion of this Court on the entitlement or otherwise of the petitioner to be released on bail, I am of the opinion that immediately after completion of investigation and filing the charge sheet, petitioner can renew his request for his release on bail. With these observations, for the present, petition is disposed of.
