JUDGMENT D.K. Paliwal, J. 1. Heard. 2. This is first bail application filed by the applicant under Section 438 of Cr.P.C. for grant of anticipatory bail. 3. The applicant is apprehending her arrest in connection with Crime No. 44/2014 registered at P.S. Ishagarh, District Ashoknagar for the offence punishable under section 306 of IPC. As per the prosecution case, Babita wife of Samudra Singh was admitted to hospital on account of consuming some poisonous substance. During treatment, she died. On this Marg intimation No. 0/13 under Section 174 of Cr.P.C. was recorded. During enquiry, it was found that the deceased was married with Samudra Singh 14 years ago. The applicant, Jeth Govind Singh, father-in-law Parvat Singh, mother-in-law Tarabai started harassing the deceased after 3-4 years of marriage saying that she is issue-less. They also used to beat her. On 9.10.2013, she consumed poisonous substance. 4. It is submitted by learned counsel for the applicant that she has falsely been implicated in the alleged offence. The applicant has not committed any offence. It is further submitted that co-accused Samudra Singh has been granted anticipatory bail vide order dated 5.5.2014 passed in M.Cr.C. No. 3680/2014 and the case of the applicant is identical with the co-accused. Hence, prayed for anticipatory bail. 5. The prayer is opposed by learned Public Prosecutor and submits that applicant is mother-in-law of the deceased and there is specific allegation against her. 6. Case diary perused. 7. It appears that the marriage of the deceased was solemnized with Samudra Singh about 14 years back. The allegation are that after 3 to 4 years of marriage the applicant along with other relatives started harassing the deceased. Ramveer and Jasrath in their statement have stated that prior to the incident a quarrel took place between the deceased and the applicant. 8. Considering the facts and circumstances of the case and considering the fact that marriage of the deceased took place about 13 years ago and co-accused Samudra Singh has been granted anticipatory bail and looking to the fact that the applicant is a lady aged about 60 years old, but without commenting on the merits of the case, this application is allowed and it is directed that in the event of arrest, applicant shall be enlarged on bail on her furnishing a personal bond in the sum of Rs. 50,000/- (Rs.
50,000/- (Rs. Fifty Thousand Only) with a surety bond in the like amount to the satisfaction of Arresting officer/competent Court. The applicant shall make herself available for interrogation by a police officer as and when required and he will co-operate in the investigation. He shall further abide by the other conditions enumerated in subsection (2) of Section 438 of Cr.P.C. 9. This order shall remain operative for a period of sixty days and during this period the applicant is free to move the regular bail application before the concerned Court. 10. C.C. as per rules.
