JUDGMENT Mr. Mehinder Singh Sullar , J.(Oral) :- Petitioner-Balbir Singh son of Kirpal Singh, has preferred the instant petition for the grant of regular bail, invoking the provisions of Section 439 Cr.P.C., in a case registered against him along with his brother and co-accused Gurmeet Singh, vide FIR No.72 dated 29.06.2012, for the commission of an offence punishable under Section 15 of The Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter to be referred as “the NDPS Act”), by the police of Police Station Kotwali, Kapurthala. 2. Notice of the petition was issued to the State. 3. After hearing the learned counsel for the parties, going through the record with their valuable assistance and after considering the entire matter deeply, to my mind, the present petition for regular bail deserves to be accepted in this context. 4. Precisely, the prosecution claimed that on 29.06.2012, petitioner-Balbir Singh and his brother Gurmeet Singh were travelling on a motorcycle. They were stopped by the police. It was claimed that in the wake of search of two bags, 70 kgs. of poppy husk was recovered from their possession. The petitioner is an Ex-Sarpanch of the village. Since, 70 kgs. of poppy husk including the weight of two bags was recovered from the possession of the petitioner and his other co-accused, so to me, the petitioner is entitled to the concession of regular bail in the obtaining circumstances of the case. Moreover, he was arrested on 29.06.2012. Since then he is in judicial custody and no useful purpose would be served to further detain him in jail. There is no history of his previous involvement in any other criminal case. The final conclusion of trial will naturally take a long time. 5. In the light of aforesaid reasons and taking into consideration the totality of facts and circumstances, emanating from the record, as discussed here-in-above, the instant petition for regular bail is hereby accepted. The petitioner is ordered to be released on bail on his filing a specific affidavit to the effect that he will not indulge in any such illegal activities in future and on his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court. ---------0.B.S.0------------
