JUDGMENT Mr. M.M.S. Bedi, J.(Oral) - Petitioner seeks concession of regular bail in a case of recovery of 60 kg poppy husk from the co-accused of the petitioner. Petitioner was found sitting on two bags weighing 20 kgs. each, when he was arrested by the police. Co-accused of the petitioner, who was sitting on third bag allegedly escaped from the spot. 2. For having been found in possession of 40 kgs poppy husk, the petitioner has been in custody since 18.11.2013. As per police record, he is not involved in any other case. 3. Taking into consideration the fact that the period of detention suffered by the petitioner will have a deterrent effect upon him not to commit the similar offence, petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bond/surety bond to the satisfaction of the trial Court subject to the condition that he will furnish an undertaking in writing to the effect that in case he is found committing the similar offence during entire trial, his bail bonds will be liable to be cancelled and this order will be deemed to have been cancelled. ---------0.B.S.0------------
