JUDGMENT Dr. Bharat Bhushan Parsoon, J. [Oral]:- Learned counsel for the petitioner prays for examining Handwriting and Finger Print Expert for which his request has already been declined by the impugned order of 23.04.2014 [Annexure P/3]. 2. Merely because the defendant has examined Handwriting and Finger Print Expert, it would not provide an opportunity to the plaintiff also to examine an expert, particularly when the plaintiff has already examined his witnesses and the defendant is at the verge of completing his evidence. 3. Learned trial Court dealing with the matter has already dealt with the entire issue with meticulous appreciation of facts and circumstances and has concluded as under :- “.. It is trite that the Handwriting and Finger Print Expert science is not a perfect science and the difference between the two Expert witnesses may be there. Furthermore, application has been moved on the ground of apprehension in the mind of the applicant/plaintiff that the respondent/defendant and the Expert witness have colluded with each other. The respondent/defendant may also be having the similar apprehension as the applicant/plaintiff has again sought the permission to examine a private Expert witness. To my mind, since the handwriting science is not a perfect science, no useful purpose would be served by calling upon another Expert witness to submit his opinion. The difference in the writing if any can be observed even by naked eye and it is not necessary to appoint an Expert for each and every thing.” 4. No ground to interfere in the impugned order is made out. 5. Dismissed. ---------0.B.S.0------------
