JUDGMENT 1. This is an application under Section 439 of the Code of Criminal Procedure for grant of bail to petitioner for offences registered under Section 8/21 of the NDPS Act in connection with Crime No. 454 of 2014 at Police Station Kotwali District Katni. 2. According to prosecution, on 7.6.2014, police Katni apprehended the petitioner along with 6 gms. of smack. 3. Learned counsel for the petitioner submits that this is the first offence ever registered against the petitioner. Petitioner is lady house wife of 58 years having no criminal past. She is in custody since 6.6.2014. Recovery proceedings is suffering from material lapses. There is no likelihood of early conclusion of the trial. 4. Learned Panel Lawyer for the State submits that sufficient evidence is available against the petitioner. 5. On due consideration of the facts and circumstances of the case, I deem it proper to grant bail to the petitioner but with condition that in the event of such similar case on the future dates, she shall be liable for cancellation of this bail also. Petitioner Smt. Kushum Bai Nishad shall be released on bail on her furnishing a personal bond in a sum of Rs.30,000/­ with surety in the like amount to the satisfaction of trial Court for her appearance in trial Court on dates to be fixed by that Court during trial. This bail shall continue during the pendency of the trial. In the event of jumping the bail, this facility will be withdrawn from petitioner. Provisions of Section 437 (3) of Cr.P.C. shall apply to the petitioner. Certified copy as per rules.
