ORDER : Ranjan Gogoi, J. Petitioner-Union of India has filed the present Special Leave Petition against the grant of bail to the respondent-accused who has served nearly eight years and eight months out of the sentence of ten years. There is a delay of 291 days. Mr. Sidharth Luthra, learned Additional Solicitor General has brought to our notice there as on for condoning the delay. In view of the fact that the petitioner being the Government and in the absence of adequate reasons, we are not inclined to condone the delay. The special leave petition is dismissed on the ground of delay. However, question of law relating to Section 37 of the NDPS Act is left open and to be decided in an appropriate case.
