JUDGMENT 1. Heard on I.A. No. 5663 of 2014, an application seeking condonation of delay in filing the present MCC. The delay is of 2 days. We find that the delay has been satisfactorily explained. 2. Accordingly, we allow the application and condone the delay in filing the MCC. By filing this MCC, the applicant/State is seeking restoration of W.A. No. 49 of 2014, which suffered dismissal for non-compliance of peremptory order. 3. According to the learned Dy. Government Advocate, as there was delay in filing the writ appeal, an application for condonation of delay was initially not filed but, it was subsequently filed and it caused delay of two days. 4. Having regard to the aforesaid, we are satisfied that there exists sufficient reason to cause the delay. Accordingly, the MCC is allowed. The W.A. No. 49 of 2014 be restored to its original number. Let a copy of this order be placed in W.A. No. 49 of 2014. C.c. as per rules.
