JUDGMENT V.K. Sharma, J.(Oral): CWP No.4383 of 2014 and CMP Nos.9374 & 9917 of 2014. It is stated that reply to CMP No.9917 of 2014 has since been filed in the Registry today in the morning, but the same is not on record. It be located and placed on record. However, the learned counsel for the petitioners has made available a copy of the reply, which is taken on record. 2. Heard. 3. The issue raised by the petitioners in this petition is relating to their continuance as Guest Faculty for imparting education to BBA, BCA and PGDCA (self financing courses) being run by a society known as ‘Higher Education Institution Society’ (HEIS), SVGC, Ghumarwin, District Bilaspur, H.P. in different subjects. Indisputably, some of the petitioners are being engaged as guest faculty on period basis for the last two academic sessions (2012-13 and 2013-14). They are seeking continuance on the basis of their academic qualification and experience. 4. Per contra, the stand on behalf of the respondents is that the engagement of some of the petitioners was on period basis for a particular session which was later on continued during the succeeding session. However, the institution now intends to engage the best possible guest faculty available for which process is already underway. It is stated that it is proposed to be by way of walk-in-interviews. 5. Against the aforementioned background, when specified technical education of children is involved, there can be no denying the fact that they get best education for the money being spent by their parents for that purpose. Keeping this aspect of the matter in view as also the agreement between the parties as set out at the Bar as also on an over-all view of the matter, the petition is disposed of with a direction to the respondents/ competent authority to permit the petitioners as well in the ensuing walk-in-interviews and assess their merit and suitability alongwith other candidates appearing in such interview for fresh engagement for the coming session. It goes without saying that such course is being adopted to harmonize the interests of all concerned including the institution, teachers and above-all the students. Needless to say that it shall be the endeavour of the respondents/competent authority to select the best possible guest faculty in the given circumstances.
