JUDGMENT 1.None present for the parties. This revision under Section 397/401 of Cr.P.C. has been filed against the order dated 01.8.2003 passed by learned Family Court, Sagar in M.J.C. No. 31 of 2003 granting Rs. 900/- per month maintenance to the wife and Rs. 600/- for daughter of the couple. 2. This application is of the year 2003. Since none is present on behalf of the applicant, it seems that with the passage of time, the applicant has lost interest in prosecuting the case. Hence, this application deserves to be dismissed in default. 3. Learned Family Court rightly held, after appreciation of evidence that the respondent No. 1 is legally wedded wife of applicant and respondent No. 2 is daughter of this couple. 4. Learned J.M.F.C. also rightly found that the applicant deserted his wife and children without any reasonable cause and having sufficient means of income to pay maintenance and, therefore, rightly awarded the maintenance amount. Hence, on the merits also, this revision under Section 397/401 of Cr.P.C. deserves to be dismissed. Accordingly, the revision is dismissed.
