Judgment : 1. This writ petition was referred for mediation to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, by the order of this Court, dated 16.9.2013. 2. A communication, dated 4.4.2014, of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, enclosing a copy of its Mediation Report, dated 11.3.2014, has been received, and in the said Mediation Report, it is stated as follows:- "Parties appeared before the Centre along with their Counsel. Parties arrived at an amicable settlement as per the terms in the Mediation Agreement. Hence the matter is sent back to the Hon'ble Court." 3. As the parties have arrived at a settlement in terms of the Mediation Agreement, dated 11.3.2014, this writ petition is listed for passing orders in terms of the said Mediation Agreement. 4. The Mediation Agreement, dated 11.3.2014, signed by the parties and their respective counsels, reads as follows:- “Both sides, out of their own volition and without any pressure or coercion from any side have agreed as follows: 1. Petitioner and 2nd Respondent agree to settle the dispute amicably between them before the Mediation Centre. 2. 2nd Respondent willing to retire his service from the Petitioner company. 3. Petitioner settled a sum of Rs.3,00,000/- (Rupees three lakhs only) as full and final settlement of all the claims which includes Back wages, Bonus, Gratuity, Retrangement Compensation, notice Pay Exgratia of the 2nd Respondent by the way of Bankers Cheque No.434052 dated 24.02.2014. 2nd Respondent receive and acknowledged the receipt of the same. 3. Petitioner and the 2nd Respondent agree that they did not have any other claims against each other.” 5. In terms of the settlement arrived at between the parties, which is recorded under the Mediation Agreement, dated 11.3.2014, and in terms of the Mediation Report, dated 11.3.2014, before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, this writ petition is disposed of, recording the terms of the Mediation Agreement, dated 11.3.2014. The terms of the Mediation Agreement, dated 11.3.2014 and the Mediation Report, dated 11.3.2014, of the Mediation Centre, shall form part of the order. Miscellaneous Petition No.1 of 2006 is closed.
