JUDGMENT 1. This is an application for bail under section 438 of Cr.P.C. for offence under Sections 392 of IPC and 120B/34 of IPC in connection with Crime No. 101 of 2014 registered at police station Lordganj District Jabalpur. 2. According to prosecution on 08/03/2014 complainant Shyamlal Sen while he was going back after collection of amount was robbed of about 7 lacs by miscreants on motor bike. 3. Learned counsel for petitioner submits that petitioner implicated in this case on the basis of information furnished by the main accused who is his son. Because of fact that son is the main accused, both father and mother are implicated in this case. Petitioner is innocent lady house wife and mother of main accused and has received nothing from main accused nor she had spent no amount anywhere out of aforesaid looted amount. 4. Learned counsel for State submits that allegations are equally serious and part of the robbed money have to be recovered. 5. In response, learned counsel for petitioner submits that petitioner will cooperate the investigating officer whole heartedly and will ensure the fair and effective investigation. Without commenting on merits of the case, on due consideration of the facts and circumstances of the case, I deem it proper to grant bail to the petitioner. Petitioner Smt. Asha Patel is directed to join the investigation immediately and fully cooperate with the investigating agency and the trial. In the event of arrest, petitioner shall be released on bail on her furnishing a personal bond in a sum of Rs. 30,000/- with a separate surety of like amount to the satisfaction of arresting officer. Conditions of Section 438(2) Cr.P.C. shall apply on the petitioner during currency of bail. C.C. as per rules.
