JUDGMENT 1. This is an application for bail under section 438 of Cr.P.C. for offence under Sections 452, 325 of IPC in connection with Crime No. 379 of 2014 registered at police station Moghat Road, Khandwa. 2. According to prosecution on 02/07/2014 petitioner assaulted the complainant Asha suspecting that niece of the complainant Pooja misguided son of petitioner and against her will married her. 3. Learned counsel for petitioner submits that in fact it was verbal quarrel and altercation took serious turn in emotional moment. Petitioner is lady house wife having no criminal past. 4. Learned counsel for State submits that allegations are serious and petitioner assaulted the complainant lady and caused grievous hurt. 5. In response, learned counsel for petitioner submits that no conventional weapon used. Without commenting on merits of the case, on due consideration of the facts and circumstances of the case, I deem it proper to grant bail to the petitioner. Petitioner Smt. Abha Singh is directed to join the investigation immediately and fully cooperate with the investigating agency and the trial. In the event of arrest, petitioner shall be released on bail on her furnishing a personal bond in a sum of Rs. 30,000/- with a separate surety of like amount to the satisfaction of arresting officer. Conditions of Section 438(2) Cr.P.C. shall apply on the petitioner during currency of bail. C.C. as per rules.
