ORDER : Jagdish Singh Khehar, Jasti Chelameswar, A.K. Sikri, JJ. In furtherance of the directions issued by this Court on 19.08.2014 requiring certain officers of the States of Karnataka and Orissa to assist this Court in preparing the flow charts regarding the examination of the proposals under the Forest (Conservation) Act, 1980, for renewal of the mining leases; the officers in conjunction with the Central Empowered Committee have submitted a Report dated 29.08.2014. The Report principally pertains to (I)processing of the proposal for In Principle (Stage-I) approval at State Level; (II) processing of the proposal for In Principle (Stage-I) approval in the MoEF; (III) processing of the proposal for formal (Stage-II) approval under the Forest (Conservation) Act, 1980, at State Level; and (IV) processing of the proposal for formal(Stage-II) approval under the Forest (Conservation) Act, 1980, in the MoEF. The flow charts depicted therein have been discussed during the course of hearing. There are no objections to the same, at the hands of the stake holders. We, therefore, hereby direct that the aforesaid flow charts shall be strictly complied with, while determining renewal of mining leases. 2. We would also consider it appropriate to direct, that Stage I and III of processing of the proposals, shall be reflected in the website of the State Government, to be maintained by the Secretary, Department of Environment and Forests; and Stage II and IV of processing of the proposals, shall be reflected in the website of the Ministry of Environment and Forests, Government of India, to be maintained by the Secretary, Ministry of Environment and Forests. Access to the websites shall be unrestricted. In the said websites, each applicant(s) will be identified on the basis of the unique code/serial number assigned to the proposal by the Nodal Officer, and by the number of the mining leases, as also, by the name of the applicant(s). The websites shall be made operational within three weeks from today. Details in respect of the existing applications shall be reflected within the time indicated hereinabove. 3. We further direct that the websites shall be on real time basis. The directions given by us shall relate to all the four flow charts, on the said basis. 4.

In case of disobedience of the directions issued by us today, it shall be open to the aggrieved party, to raise a challenge to the same, in the jurisdictional High Court under writ jurisdiction exercised by the concerned High Court. In case such a challenge is raised, it will be appreciated, if matters emerging out of the provisions of the Mines and Minerals (Development and Regulation) Act, 1957 are taken up for consideration by a Division Bench of the High Court. 5. We place on record our appreciation for the assistance rendered to us, by the Officers of the States of Karnataka and Orissa, and also, the Ministry of Environment and Forests, Government of India. 6. For consideration of rest of the issues, list again on 08.09.2014. I.A. No.212 in Writ Petition(C) No. 562/2009 Learned counsel for the State of Karnataka states, that there is a typographical error in the notification depicting the particulars of the field survey numbers of the villages which were to be treated as reserved forest, under the provisions of the Karnataka Forest Act, 1963. Learned counsel seeks a week's time, so as to enable her to take appropriate steps. Prayer is allowed. List again on 22.9.2014.
