JUDGMENT : M.M.S. Bedi, J. Petitioners were arrested on the basis of secret information that they indulged in smuggling of heroin. They were arrested while driving motorcycle on October 22, 2013. The period of 180 days expired on April 20, 2014. The application for extension under Section 36 A (4) of the NDPS Act was filed on April 17, 2014. The petitioner moved an application under Section 167 (2) Cr.P.C. on April 19, 2014. The application for extension under Section 36 A (4) was allowed on April 28, 2014 granting 30 days time till May 17, 2014. As the report had not been received, another application was filed for extension of time on May 17, 2014 by the Public Prosecutor. 2. The said application has now been dismissed on May 21, 2014. 3. On the instructions of ASI Sarabjit Singh, State counsel has informed that till date challan has not been presented and that the prosecution agency has not been granted any extension. It has been informed by ASI that petitioners are involved in a number of cases. Pendency of number of cases against the petitioners is not sufficient ground to defeat the indefeasible right of the petitioners to be released in case the challan is not presented within a statutory period. 4. Petition is allowed. Petitioners are ordered to be released on bail on their furnishing bail bonds/ surety bonds to the satisfaction of Special Judge, Amritsar.
