JUDGMENT 1.Heard on the bail application. Case-diary has been perused. 2. This is the first bail application filed by the applicant under Section 439 of the Cr.P.C. for grant of bail. 3. Applicant has been arrested on 04-05-2014 in connection with Crime No. 52 of 2014 registered at Police Station Chinore District Gwalior for the offence punishable under Sections 304-B and 498-A, 34 of IPC. 4. As per prosecution story, incident occurred on 04-03-2014 when Geeta has consumed some poisonous substance. Her marriage was solemnized with Sonu Baghel who is Dewar of present applicant, 3 years prior to the date of incident i.e. on 06-05-2014. Marg No. 90 of 2014 was registered by the police. 5. Prayer for bail was made on the ground that dying declaration of Geeta is shown to be recorded on 05-04-2014 but Geeta had died on 05-03-2014 which shows that this document has been falsely prepared by the police after a period of one month. It was also prayed that present applicant is living separately. Final disposal of trial shall take time, hence prayed for grant of bail. 6. Prayer for bail was opposed by learned Panel Lawyer on the ground that specific allegations were made against the applicant in dying declaration though date of recording of dying declaration has been wrongly mentioned due to mistake. Apart that, spot map dated 24-03-2014 shows that in the same house no doubt in a separate room applicant resides and outside her room dead body of Geeta was found, therefore, on the ground of separate living benefit of bail cannot be granted to the applicant. 7. Looking to the facts and circumstances of the case and the fact that omnibus allegations were made in the dying declaration; neither any date nor time has been shown in relation to cruelty committed with her and further looking to the Ration Card which shows that applicant is residing separately, but without commenting on the merits of the case, the present application is allowed and it is directed that the applicant be released on bail on her furnishing personal bond in the sum of Rs. 50,000/- (Rs.
50,000/- (Rs. Fifty Thousand Lac Only) with one solvent surety of the like amount to the satisfaction of the Trial Court for her regular appearance before the trial Court on the condition that she shall remain present before the Court concerned during the trial and shall also comply with the conditions enumerated under Section 437(3) of Cr.P.C. and so also as imposed by the trial Court. 8. A copy of this order be sent for compliance to the Court concerned. Certified copy as per rules.
