JUDGMENT Mr. S.S. Saron, J.: - Heard learned counsel for the parties. 2. The petitioner seeks regular bail in a case registered against him vide FIR No. 271 dated 01.11.2012 for the offences punishable under Sections 307, 120-B, 148, 149, 34 Indian Penal Code read with Section 25 of the Arms Act registered at Police Station Kotwali, Patiala. 3. The FIR has been registered on the statement of Kala @ Commando. It has inter alia been alleged by the complainant that his father Bhola Ram died in September 2011. After his demise dispute arose between him (complainant) and his brother Soni (accused) regarding division of the house. About two months earlier to the incident that occurred on 01.11.2012, the complainant came from Central Jail, Patiala. On coming out he came to know that his brother’s wife Rupa had engaged contract killers for murdering him, who along with his brother Soni had bought some weapons for killing the complainant– Kala @ Commando. On the date of the incident i.e. 1.11.2012 at about 11 a.m., the complainant was sitting in his house with his sister Asha and was talking to her. At that time Soni and Raj @ Gohra came down from the terrace and raised a ‘lalkara’ that Commando (complainant) should not escape and he be finished. Thereafter, Soni fired at him (complainant) from his country made pistol which hit him (complainant) on his neck. The complainant shouted ‘marta marta’ on which Soni and Raju @ Gohra ran away from the spot with their weapon. The complainant along with his sister Asha were coming to inform the police and when they reached a bridge near Ghalauri Gate near CIA Patiala, there again brother of the complainant i.e. Soni and his friend Raju @ Gohra fired at him from the country made pistol and the persons standing along with them i.e. Sunder, Bindu son of Ram Parshad, Rupa wife of Soni, Ram Parshad etc. started throwing bricks and stones at him (complainant). The bullet fired by Raju @ Gohra hit him on the right side of his stomach. On this they shouted ‘marta marta’ and sought help. There also the said persons ran away along with their weapons. Blood started oozing out due to the bullet injuries and the complainant was taken in an injured condition by his friend Deepak with the help of his sister Asha. He was got admitted in the emergency ward of Rajindra Hospital Patiala. Soni and Raju @ Gohra fired upon him with the intention to kill him. The petitioner is also stated to be involved in the case. 4. Admittedly, petitioner is not shown to be present at the time of occurrence but he is said to have been engaged for killing the complainant and is also stated to be involved in the case. No overt act has been attributed to him. The petitioner is in custody since 26.02.2013. The accused Soni who is brother of the complainant has been granted concession of bail by this Court vide order dated 04.03.2014 passed in Crl. Misc. No. M-32967 of 2013. 5. Keeping in view the facts and circumstances of the case, it would be just and expedient to admit the petitioner to bail. 6. Consequently, the Crl. Misc. petition is allowed and the petitioner on his furnishing personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Patiala, shall be released on bail. ————————
