JUDGMENT Heard learned counsel for the applicant and the learned AGA. 2. This is first bail application filed on behalf of the applicant Rajendra Raidas in case crime no.239 of 2013, under Sections 302,201 IPC, Police Station Phoolbehar, District Lakhimpur Kheri. 3. According to the prosecution version, a dead body was found in the agricultural field of Saligram besides Chak Road and one Vishw Nath Singh informed the police at about that 23.3.2013 at about 8.30 P.M. Later on, the dead body was identified to be of Smt. Laxmi Raidas wife of Vishram Raidas. 4. It was submitted by learned counsel for the applicant that applicant is not named in the first information report. In the statement of other witnesses only apprehension was expressed that this Act might have been done by the present applicant. It was further submitted that allegedly there is extra judicial confession of the applicant before several persons but the prosecution version is silent as to what was the occasion of the applicant to confess before so many persons. 5. Learned AGA has opposed the bail on the ground that after the dead body was identified this extra judicial confession came into the light and the witnesses specifically informed the investigating officer when they were interrogated. Considered the rival submissions. 6. Applicant is brother of the deceased. There are several witnesses who have informed the investigating officer that applicant came to them and confessed that he has killed his sister by strangulating her. 7. At this stage, considering the evidence collected by the investigating officer, applicant is not entitled for bail. 8. The bail application of the applicant is rejected.
