ORDER The writ petition is filed for a mandamus declaring the action of the 3rd respondent in suspending the authorisation of the petitioner as fair price shop dealer vide orders dated 17.7.2014, as illegal and arbitrary and to set aside the same and for a direction to the respondents to allot the essential commodities to the petitioner's fair price shop. 2. The case of the petitioner is that he was appointed as fair price shop dealer for Shop No.75, Veerapuram Village, Gummagatta Mandal, Anantapuram District on permanent basis and distributing the essential commodities to the cardholders without any complaint. While so, the 3rd respondent issued show-cause notice-cum-suspension order dated 17.7.2014, pending enquiry. It is submitted by the learned Counsel for the petitioner that petitioner submitted his explanation on 28.7.2014, but the 3rd respondent did not pass any orders and the petitioner's authorisation is being kept under suspension. Aggrieved by the same, present writ petition is filed. 3. Heard both sides. 4. This Court held that suspension of fair price shop authorisation cannot be in a routine manner unless serious allegations are made against the petitioner. Since the learned Counsel for the petitioner submits that petitioner submitted his detailed explanation on 28.7.2014 to the show-cause notice, the impugned order dated 17.7.2014 is set aside. However, it is open for the 3rd respondent to conclude the enquiry and pass final orders in pursuance of the show-cause notice dated 17.7.2014. Till final orders are passed by the 3rd respondent, the petitioner shall be continued as fair price shop dealer. 5. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
