JUDGMENT 1. Heard. Perused the case diary. This is the first application under Section 439 Cr.P.C. filed on behalf of the applicant. 2. Applicant has been arrested on 07.07.2014 in connection with Crime No. 246 of 2014 registered at Police Station Vishwavidyalaya, District Gwalior (M.P.) for the offence punishable under Section 34(2) of M.P. Excise Act. 3. As per the prosecution story, 56 Litres of country made liquor has been seized from the possession of the present applicant on 07.07.2014. 4. Looking to the facts and circumstances of the case, since there are no criminal antecedents against the present applicant, charge-sheet has already been filed and that the final disposal of the case will take time, this court is inclined to grant bail to the applicant, hence, application is allowed and it is directed that applicant-Smt. Noorjahan alias Noorbi be released on bail on her furnishing a personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety of the like amount to the satisfaction of the Trial Court, subject to condition that she shall remain present before the Court concerned during trial and also comply with the conditions enumerated under Section 437(3) of Cr.P.C. A copy of the order be sent to the Court concerned for necessary compliance. Certified copy as per rules.
