JUDGMENT Calling in question tenability of an award passed by the competent authority under Section 3 of the National Highways Act, 1956, this writ petition has been filed. However, from Annexure P/4, it is seen that an application for seeking arbitration has been filed before the Commissioner, Rewa, the competent authority under Section 3(g)(5) of the National Highways Act and, therefore, the petition directly before this Court is not maintainable, as the appeal is pending. Keeping in view the aforesaid, for the present without entering into the controversy on merit, it is directed that on the petitioner's appearing and filing a certified copy of this order along with a memorandum of appeal Annexure P/4 filed under Section 3(g)(5) before the respondent No. 5, the said respondent shall decide the same in accordance with law after hearing all concerned within a period of 45 days from the date of receipt of certified copy of this order. With the aforesaid, the petition stands disposed of.
