JUDGMENT Brijesh Kumar Srivastava-II, J: - Heard learned counsel for the accused-applicants and learned A.G.A. for the State. 2. I have perused the F.I.R. and other relevant papers filed in support of the bail application. 3. This bail application has been preferred by the accused-applicants, Ram Singh, Avadesh and Dharmesh, who are involved in Case Crime No.428/2012, under Sections 308, 323, 504 and 506 I.P.C., Police Station-Nighasan, District-Kheri. 4. It is submitted by learned counsel for the accused-applicants that it is cross-case and both sides have received injuries on their person. Further it is submitted that charge-sheet has been filed. Co-accused Sushil has already been granted bail by court order dated 20.12.2013 in Bail No.8210 of 2013. 5. It is further submitted that accused-applicants have no criminal history as averred in para 13 and they are languishing in jail since 27.11.2013 as averred in para 11 of the affidavit. 6. It is lastly submitted that the accused-applicants are not likely to abscond or tamper with the prosecution evidence. 7. Learned A.G.A. opposed the prayer for bail on the ground of nature of injuries. 8. In view of the facts and circumstances of the case and submissions made by learned counsel for the accused-applicants and learned A.G.A. and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail. 9. Let the accused-applicants, Ram Singh, Avadesh and Dharmesh, be released on bail in the aforesaid case crime number on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to the condition that in case any adverse thing is brought to the notice of State, the State will at liberty to move bail cancellation application.
