JUDGMENT : - Dharam Chand Chaudhary, Judge. (Oral) Learned Additional Advocate General has placed on record status report and the Investigating Officer, ASI Charan Singh, Police Station, Nurpur, has produced the record. 2. The accused-petitioner has been booked for the commission of an offence punishable under Section 302 of the Indian Penal Code. The alleged offence committed by her is not only grievous, but heinous also, as she allegedly has murdered her own husband. This Court has been informed that the trial against her is now listed in the Court below on Record reveals that one of the material witnesses is Kumari Priya Devi, minor daughter of the accused-petitioner. The apprehension that she may influence her minor daughter, if admitted on bail, seems to be justified. 3. Learned counsel for the petitioner, at this stage, therefore, seeks permission to withdraw this petition with liberty to file a fresh after recording the statements of material prosecution witnesses, especially that of Kumari Priya Devi. Permission, as sought, is granted. The application is accordingly dismissed as withdrawn. It is expected from the trial Judge that the statements of material prosecution witnesses, including that of Kumari Priya Devi, will be recorded on the next date of course subject to entertaining all cooperation for the purpose by the accused-petitioner and the petitioner. The application stands accordingly disposed of.
