JUDGMENT Mr. Jitendra Chauhan, J.: - By filing the present appeal, the appellant has sought enhancement of the compensation awarded by the learned Motor Accidents Claims Tribunal, Kurukshetra (in short ‘the Tribunal’), vide award dated 1.12.2011. 2. It is contended that the appellant remained hospitalised from 26.6.20910 to 12.7.2010, on account of the injuries suffered by her. Nothing has been granted towards the heads ‘special diet’, ‘attendant and transportation charges.’ The amount awarded towards pain and suffering, in view of the injuries, is also inadequate. 3. On the other hand, the learned counsel appearing for the Insurance Company submits that adequate compensation has been granted by the learned Tribunal. Thus, the present appeal deserves to be dismissed. 4. I have heard the learned counsel for the parties and perused the case file. 5. As per the MLR, Ex.P5, the appellant suffered multiple injuries including fracture in the right leg. She remained hospitalised for 18 days. She suffered disability to the extent of 3%. On account of the injuries, the appellant suffered agonising pain. The amount awarded towards pain and suffering i.e. Rs.5000/- is grossly inadequate, keeping in view the nature of injuries. Accordingly, the same is enhanced from Rs.5,000/- to Rs.25,000/-. From the perusal of the award, it emerges that no amount has been awarded towards special diet, attendant charges and transportation charges. This Court feels that the ends of justice would be met, if another sum of Rs.15,000/- under all these heads is granted. Ordered accordingly. 6. Accordingly, the enhanced amount i.e. Rs.35,000/- shall be paid to the claimant-appellant, within 45 days from the date of the receipt of the certified copy of the judgment, failing which, the appellant shall be entitled to get interest @ 8% per annum from the date of the filing of the appeal till its realisation. 7. In view of the above, the present appeal is partly allowed and the impugned Award is modified to the above extent. ---------0.B.S.0------------
