Judgment : 1. We have heard learned counsel appearing for the parties. 2. Learned Single Judge dismissed the writ petition filed against the transfer of the appellant serving as the Senior Teacher (Mathematics) from Government Bhagwati Devi Bajoria Senior Secondary School, Shastri Nagar, Jaipur to Government Senior Secondary School Ramnagar, Jamwa Ramgarh, District Jaipur at the distance of 75 k.m. 3. Learned counsel appearing for the petitioner states that the petitioner, as a Senior Teacher, was also required to discharge the duties of Booth Level Officer in the Panchyat Raj Elections. These duties as Booth Level Officer are extended beyond the period of elections, in which a Booth Level Officer is required to prepare the election rolls. Since the petitioner cannot be relived as Booth Level Officer, he could not be transferred to serve in a school, which is far away from the school in which he is discharging the duties. 4. Learned Single Judge has considered the submission, and found no substance. He has also examined the result in the subject of the Mathematics of the school, which was not fount it to be impressive to consider the appellant to continue in the same school. 5. In the elections, the teachers are appointed as Booth Level Officers. The Panchayat Elections were concluded after the declaration of election results in January & February, 2015. The Booth Level Officer are not required to discharge any duties thereafter. 6. The petitioner, being a Teacher, does not have any such right to continue to serve as the Booth Level Officer to resist his transfer. In any case, the transfer has been made within the district of Jaipur at a short distance which will not cause any inconvenience to him. 7. The Special Appeal is dismissed.
