Order 1. The petitioners have come forward with these petitions seeking police protection for celebration of the temple festival of the Arulmigu Muniyasamy @ Virumbandi Pettai Kovil on 16.01.2015, situated at Thanankankulam Village, Thiruparankundram Circle, Madurai District. 2. Heard the learned Counsel appearing for the petitioners and the learned Government Advocate (Crl.Side). 3. Taking into consideration of the submissions made on behalf of the petitioners and objections thereto, this Court is of the view that the earlier order of this Court, passed in Crl. O.P. (MD). No. 13884 of 2014, dated 31.07.2014, would best meet the needs of the situation, pending resolution of the dispute by the Civil Court, where before admittedly, an action is pending. Operative portion of the order reads as follows: “5. Admittedly, there are two Vagaiyaras, namely Muthumaya Thevar Vagaiyara and Muthu Vagaiyara. If at all, any other person seeks any other claim, only these two Vagayaras are entitled to claim. In view of that, the petitioner is directed to conduct the festival in the morning 10.00 a.m. to 01.00 p.m. by which time the intervenor should not interfere with the said worship of the petitioner's group. Similarly, Muthumari Vagaiyara is permitted to worship/conduct the festival between the 06.30 a.m. to 09.30 a.m. by which time, the petitioner's group should not interfere with the intervenor's worship/conduct of the festival. 6. The respondents are permitted to give adequate police protection and both parties are directed to co-operate with the police to maintain law and order without creating any problem. It is made clear that Virumandi Swami, Muthukaruppana Swami, Pechiyamman Swami and Virumandi Swami Petti (Petti Samy) should not be carried by any of the parties. 7. With the above direction, the Criminal Original Petition is disposed of.” 4. Accordingly, this Court permits the petitioner in Crl. O.P. (MD). No. 140 of 2015 to conduct the festival on 16.01.2015 between 12.00 p.m. and 03.00 p.m. the petitioner in Crl. O.P. (MD). No.188 of 2015 is permitted to conduct the festival on 16.01.2015 between 08.00 a.m. and 11.00 a.m. and the petitioner in Crl. O.P. (MD). No. 233 of 2015 is permitted to conduct the festival on 16.01.2015 between 03.00 p.m. and 06.00 p.m. One group should not interfere with the worship of another group. 5. Accordingly, these Criminal Original Petitions are disposed of.
