JUDGMENT P.S. Rana, J. Present appeal is filed under Section 378 Cr.P.C. against the judgment of acquittal passed by learned Judicial Magistrate 1st Class Court No. (IV) Una District Una H.P. in criminal RBT case number. 279-II-2008/2007 titled State of H.P. vs. Ravinder Kumar decided on 16.1.2015 relating to criminal offence under Section 379 IPC and Sections 41 and 42 of Indian Forest Act. Criminal offence under Section 379 IPC is cognizable and non-bailable offence. In view of the amendment in Cr.P.C. 1973 w.e.f. 23.6.2006 appeal relating to acquittal order passed by Judicial Magistrate in respect of cognizable and non-bailable offence lies to Sessions Court. In view of the above stated facts present appeal is transferred to learned Sessions Judge Una for disposal strictly in accordance with law. Be listed before learned Sessions Judge Una on 11.9.2015. Learned Registrar (Judicial) is directed to transmit the record to learned Sessions Judge immediately.
