Judgment : 1. This writ petition is filed praying for issuance of writ of certiorari for quashing order dated 01.09.2006 wherein the claim of the petitioner for being appointed as Laboratory Assistant in Education Department being the brother of deceased Subash Chander who died in harness under SRO 43 came to be rejected. The petitioner seeks further direction to the respondents to issue order of appointment as Laboratory Assistant in Education Department under SRO 43. 2. The case of the petitioner is that his brother was working as Teacher in the Education Department and while in service died on 21.10.2003 leaving behind father mother and three sisters. The petitioner was minor at the time of death of his brother. The petitioner applied for compassionate appointment under SRO 43. The said claim was rejected without stating any reason. The application seeking review of the said rejection order was also rejected without stating any reason for such rejection. 3. Considering the fact that no reason has been mentioned in the rejection order, the order dated 01.09.2006 is set aside and the matter is remitted to respondent No.1 to reconsider the claim of the petitioner and pass a speaking order in accordance with the law within a period of eight weeks from the date of receipt of copy of this order. 4. Disposed of.
