Judgment : Mansoor Ahmad Mir, Chief Justice (oral) Challenge in this Letters Patent Appeal is to the judgment dated 5th March, 2010, passed by the learned Single Judge in CWP (T) No. 4662 of 2008, titled Shri Joginder Singh Attal versus The he Secretary, HPSEB & another, whereby the writ petition came to be allowed and the writ respondents-appellants herein, were directed to consider the case of the writ petitioner-respondent herein, for grant of extraordinary pension, for short ‘the impugned judgment’. 2. We have gone through the impugned judgment, which is well reasoned. Pension is the right of an employee and cannot be denied to him/her on the ground of delay and laches. The Writ Court has rightly made the impugned judgment. 3. Having said so, no case for interference is made out. Accordingly, the impugned judgment is upheld and the appeal is dismissed. 4. Pending application stands disposed of.
