JUDGMENT : Kurian Joseph, J. Leave granted. 2. The High Court while hearing the second appeal framed two questions. It is not in dispute that the question No. 1 does not pertain to subsequent event since Rangbahadur Mathur died as early as in 1986. Therefore, it is the second question that has to be decided by the High Court while hearing the appeal. We, therefore, allow this appeal making it clear that the findings to be recorded by the first appellate court will be limited to the question No. 2 only. The court shall record the findings within a period of six months from the date of communication of this order. 3. The appeal is accordingly allowed to the extent indicated above.
