ORDER : 1. This revision petition has been filed under Section 53 of the Juvenile Justice (Care and Protection of Children) Act, 2000 (for short the Act of 2000) against the order dated 9.6.2015 passed by the Sessions Judge, Jhunjhunu in Cr. Appeal No.60/2015 by which appeal of juvenile was dismissed and order of Juvenile Justice Board was upheld, which relates to FIR No. 104/2015 registered at Police Station, Mukundgarh, District, Jhunjhunu for offences under sections 376, 354C & 506 IPC. 2. I have heard arguments of learned counsel for both the parties. 3. Learned counsel for the petitioner has sought support from the following four rulings of the Rajasthan High Court:- (1) Maharaj Singh vs. State of Rajasthan – 2010 WLC (Raj.) (Raj.) 254 4. State of Rajasthan – 2012 WLC (Raj.) UC 506 (3) Deepak Kumar Vs. State of Rajasthan – 2012 WLC (Raj.) UC 605 (4) Bhanwar Lal Vs. State of Rajasthan – 2007 (1) Cr.L.R. (Raj.) 254 4. Section 12(1) of the Act of 2000 also provides that a juvenile shall not be released on bail, if there appear reasonable grounds for believing the the release is likely to bring him into association with any known criminal or expose him to moral, physical or psychological danger or that his release would defeat the ends of justice. 6. Apparently, looking to the charges against the juvenile delinquent, his release on bail will certainly defeat the ends of justice in this case. Other apprehensions expressed by the court below are also not baseless. 7. In the circumstances, this revision petition filed by juvenile delinquent Ajay Kumar @ Jai Singh through his mother is hereby dismissed. The Juvenile Justice Board is hereby directed to expediate the trial of the juvenile delinquent. 8. Copy of this order be sent to the concerned Juvenile Justice Board as well as also to the Sessions Judge, Jhunjhunu.
