Judgment : 1. This writ petition is filed praying for issuance of writ of mandamus directing the respondents to decide the case of the petitioner pending consideration for appointment on compassionate ground within some stipulated time frame. 2. The case of the petitioner is that his father was working in the department of respondents Nos.2 &3 as Driver and while serving so, died in harness on 20.12.1990 and the petitioner applied for compassionate appointment in the year 1993 and no action was taken to consider the claim of the petitioner seeking compassionate appointment. 3. In response to the prayer made in the writ petition, reply has been filed by respondent Nos. 2&3 stating that the claim Of the petitioner was considered and rejected vide order dated 17.04.1995. 4. In light of the stand taken in the counter affidavit stating that claim of the petitioner was considered and rejected on 17.04.1995, the prayer sought for in the writ petition cannot be entertained and accordingly the same is dismissed granting liberty to the petitioner, if he is having any valid claim, it is open to him to challenge the same in accordance with law. 5. Disposed of.
