Judgment 1. Mr. M. Raja Rajan, learned Government Advocate, takes notice for the respondents 1 to 3 and Mrs. S. Bharathi, learned Government Advocate takes notice for R4. By consent of both the parties, the main writ petition itself is taken up for final disposal at the stage of admission. 2. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents. 3. The petitioner seeks for a Writ of Mandamus to direct the first respondent to disburse the death-cum-retirement benefits of her husband and family pension and all other service benefits. 4. It is stated that her husband namely Krishnan S/o. Neelan was working as a Sweeper in Attoor Town Panchayat from 05.07.1965 and died on 13.05.2000, while he was in service. According to the petitioner, he has left behind the petitioner and six children as his legal heirs. The grievance of the petitioner is that after the death of her husband the retirement benefits are not given to the petitioner in spite of her request. It is further stated that the first respondent has sought for clarification through proceedings dated 12.03.2013 from the Executive Officer of the Aatoor Town Panchayat, with regard to the claim made by the petitioner and thereafter the petitioner has sent a representation on 30.09.2014, explaining the details with regard to the clarifications sought for by the first respondent. It is stated that the said representation has not been considered so far and the same is still pending. 5. Considering the fact that the representation sent by the petitioner clarifying all the factual aspects is still pending, it is for the first respondent to consider the representation of the petitioner dated 30.09.2014 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
