JUDGMENT Shabihul Hasnain, J. Heard Sri Vinay Prakash Tiwari, learned counsel for the petitioner and Sri U. N. Mishra for the opposite party. 2. Sri U. N. Mishra was directed by the Court to appear on behalf of the District Judge and assist the Court. On the directions of this Court, Sri U. N. Mishra has obtained instructions. However, on the basis of instructions he has prayed that he may be granted time to file affidavit bringing true facts of the case before the Court. 3. However, before any order could be passed Sri Vinay Prakash Tiwari submits that on the day of filing of this case he was not aware of the true facts of the case and his client also was in the dark. Today certain facts have come to his knowledge. He says that he was not in the knowledge that a special appeal against order dated 7.5.2013 has already been filed by the Registrar General of High Court bearing Special Appeal Defective N.690/2013. An order has been passed by a Division bench on 16.7.2013 and the order for which contempt is being alleged has been kept in abeyance by the Division Bench, as such, after knowledge of this fact he does not want to press this petition any more Accordingly, the petition is dismissed as withdrawn.
