Judgment : 1. This writ petition is filed praying for issuance of writ of mandamus, directing the respondents to finalize the petitioner’s claim for compassionate appointment in accordance with the recommendations and of course condoning the delay which has occasioned due to the non-processing of the case for the last so many years. 2. The case of the petitioner is that petitioner’s father namely Sh. Raj Gopal, while working as Technician Grade-IV in the Power Development Department, died in harness on 11.02.2000 and the petitioner was minor at the time of death of his father. The petitioner filed an application seeking compassionate appointment under SRO 43 of 1994 and the said application was processed after a gap of four years after the death of his father and at that time the petitioner attained the age of majority. However, no final order has been issued as to whether the petitioner is entitled for compassionate appointment in terms of SRO 43 of 1994 or not. Even though the respondents are served as early as in the year 2006, no reply has been filed to oppose the prayer made in the writ petition. 3. Learned counsel appearing for the petitioner submits that respondent No.3 is the competent authority to consider the claim of the petitioner seeking compassionate appointment. 4. Since the application is pending before respondent no.3, he is directed to pass appropriate order in accordance with law within a period of eight weeks from the date of receipt of copy of this order. 5. Disposed of.
