Judgment : Mansoor Ahmad Mir, Chief Justice (oral) This appeal is directed against the award dated 19th March, 2009, passed by the Motor Accident Claims Tribunal(I), Mandi, H.P. (for short, “the Tribunal”) in Claim Petition No.69 of 2003, titled Smt. Rupa Devi & another vs. H.R.T.C. & others, whereby the claim petition came to be dismissed (for short the “impugned award”). 2. The Tribunal dismissed the claim petition on the ground that the claim petition arising out of the same accident was pending before Motor Accident Claims Tribunal(III), Kangra at Dharamshala, which was decided against the claimants-appellants. The award was upheld by this Court with modification that the insurer of the offending vehicle has to satisfy the award, which has attained finality. 3. Having said so, the Tribunal has rightly made the impugned award. Accordingly, the appeal is dismissed. 4. Send down the record after placing copy of the judgment on the Tribunal’s file.
