JUDGMENT : This is an application for suspension of sentence on behalf of applicant-appellant Baljit Singh @ Mota son of Billu Singh convicted for an offence under Section 15 and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the Act'). 2. Learned counsel for the applicant-appellant contends that the applicant was not apprehended at the spot and was not the owner of the vehicle. There is no evidence of the prosecution to prove that he was owner of the vehicle from which 350 KGs of poppy husk was recovered. Therefore, the conviction under Section 25 of the Act is without any evidence. 3. He also argued that the applicant-appellant was not apprehended at the spot even when the police party was consisting of 8 officials. The prosecution allegations of the applicant-appellant being in conscious possession of poppy husk cannot be sustained. It is also pointed out that the applicant-appellant was on bail during trial as well. 4. As per the custody certificate produced by Ms. Deepa Singh, Additional Advocate General, Punjab, there is no other case pending against the applicant-appellant under the Act. 5. Keeping in view the circumstances in which the applicant-appellant was arrested and the fact that he is not the owner of the vehicle, we deem it appropriate to allow the application and suspend the sentence imposed upon the applicant-appellant Baljit Singh @ Mota. He be admitted to bail to the satisfaction of learned Chief Judicial Magistrate, Patiala.
