JUDGMENT 1. - This second bail application has been filed under Section 439 Cr.P.C. 2. The brief facts of the case are that an FIR No. 267/2014 was registered at P.S. Gandhi nagar, Ajmer for offence under Section 457 and 380 IPC. The investigation was commenced and during the course of investigation, petitioner was arrested. He moved the bail application before the court below but same was dismissed. He thereafter move earlier bail application before this court, but same was also dismissed on 7.10.14 with liberty to file fresh upon the changed circumstances. 3. Learned counsel for the petitioner has contended that now investigation has been completed, challan has been filed, and the alleged a offence is triable by Ist Class Judl. Magistrate, accused petitioner is in judicial lockup since long, trial of the case is likely to take time. Hence, the accused petitioner should be released on bail. 4. Learned Public Prosecutor has opposed the bail application. 5. Looking to the facts and circumstances of the case, but without expressing any opinion on the merits and demerits of the case, I deem it just and proper to release the petitioner on bail. 6. Therefore, this second bail application is allowed and it is directed that accused petitioner Dayal Ram S/o Tulcha Ram shall be released on bail under Section 439 Cr.P.C. in connection with FIR No. 267/2014, registered at Police Station Gandhi Nagar, Ajmer, provided he furnishes a personal bond in the sum of Rs. 2,00,000/- (Rupees two lac) together with two sureties in the sum of Rs. 1,00,000/- (Rupees one lac) each to the satisfaction of the trial court with the stipulation that he shall appear before that court on all subsequent dates of hearing and as and when called upon to do so.IInd bail application allowed. *******
